Under the Bioterrorism Act of 2002 and the Food Safety Modernization Act of 2011, facilities which engage in the manufacturing, processing, packing, or holding of food for consumption in the US must register with the Food and Drug Administration (FDA). These facilities are required to reaffirm the information submitted by renewing their registration during the fourth quarter of every even numbered year. This year, facilities subject to these requirements must renew their FDA registration between October 1st and December 31st 2018. Failure to fulfill this requirement may result in the suspension or cancellation of a facilities’ registration number and impede shipments from import to or export from the US. Registration renewal should be completed online via FDA’s Registration of Food Facilities page.
Additionally, as part of their registration, foreign based facilities must designate a US agent. The “agent” is responsible for routine and emergency food related communication between the FDA and the foreign facility.
